Workplace Relations Commission Adjudication Officer: Kevin Baneham
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
At the time the adjudication was scheduled to commence, it was apparent that the complainant was not present and there was no attendance on his behalf. Two witnesses for the respondent were present to meet the claim. I verified that the complainant was on notice of the time, date and venue of the adjudication. I waited some time to accommodate a late arrival. Having taken these steps, I proceeded with the adjudication in the absence of the complainant.
Summary of Complainant’s Case:
The complainant did not attend the adjudication to set out how the respondent contravened the above statutes. |
Summary of Respondent’s Case:
The respondent was present to meet the claims. |
Findings and Conclusions:
The complaints are not well founded. The complainant has not presented evidence of contraventions of either the Organisation of Working Time Act or the Minimum Notice and Terms of Employment Act. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00028646-001 I find that the complaint pursuant to the Organisation of Working Time Act is not well founded.
CA-00028646-002 I find that the complaint pursuant to the Minimum Notice and Terms of Employment Act is not well founded. |
