Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00020949-001 | 01/08/2018 |
Date of Adjudication Hearing:02/05/2019
Workplace Relations Commission Adjudication Officer:Ewa Sobanska
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted his complaint to the WRC on 1st August 2018 claiming that his employer has not paid him or has paid him less than the amount due to him. At the time the adjudication hearing was scheduled to commence, it became apparent that there was no appearance by either party. I am satisfied that the parties were notified of the venue, date and time of the hearing. I waited some time to accommodate a late arrival. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
As the parties did not attend the adjudication hearing I do not make any findings or conclusions. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
As the Complainant did not attend the adjudication hearing to advance his complaint, the complaint fails for want of prosecution and I declare the complaint to be not well-founded. |
