Workplace Relations Commission Adjudication Officer:
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant was seeking unpaid wages and two weeks holiday pay. |
Summary of Complainant’s Case:
The Complainant was employed as a Chef from May 24th 2014 to July 28th 2018 and when he handed in his notice he was not paid one weeks pay due of 760.84 Euros and was owed two weeks holiday pay of 1,319.35 Euros. Both of these amounts were not paid to him by the Respondent even though he was given a pay slip showing it would be paid. The Complainant was not sure of his legal employer name but clarified it at the Hearing based on his payslips to be Tasty Choice Catering Ltd. |

I am satisfied the Respondent was notified of the date, time and location of the Hearing but was not present at the Hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the uncontested evidence of the Complainant I award him 760.84 Euros pay (CA-00021864-001) and 1.319.35 Euros Holiday Pay (CA-00021865-001). |
