Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is an employee of the Respondent and commenced employment on 15/06/2011. The Complainant is employed as a knife operator and is paid €457.00 gross per 40-hour week. This complaint was received by the Workplace Relations Commission on 26th November 2018. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing and no word was received from him regarding his non-attendance. Correspondence in relation to the hearing of the complaint was sent to the Complainant on 25th April 2019. |
Summary of Respondent’s Case:
The Respondent attended the hearing and were in a position to present a defence. |
Findings and Conclusions:
As the Complainant did not attend for hearing and failed to offer any explanation regarding his non-attendance I have to find that the complaint is not well found and therefore fails. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
