Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 – 2014 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

Summary of Complainant’s Case:
The Complainant did not get paid in April 2018 but eventually received pay in June 2018. Her start date with the company was 4 September 2014. The Complainant received notice in writing of redundancy and finished work on 4 May 2018. The Complainant did not receive her redundancy pay but requested this by email. Her salary was €2916.66 gross for 40 hour week and provided a payslip to confirm this. She waited until now to progress with the claim hoping that she would get payment from the company via Social Insurance Fund but that did not happen. The Complainant states that all four Directors including the CEO have not responded in relation to signing the redundancy form or to issue payment. They have ignored all contact and simply walked away. The Complainant stated that she was promised the week of her notice period that she would receive her entitlement but there has been no word since. The Complainant is not sure if the company is insolvent or what the current situation is as the office is closed. |

Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
The Complainant is entitled to a redundancy payment in accordance with the details set out above. |
