Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed as a Fitness Instructor from 25th September 2018 to 1st January 2019. She was paid €15.00 per hour and worked an average of 8 hours per week. She has claimed that she is owed wages. |
Summary of Complainant’s Case: |
The Complainant stated that she is owed wages of €105 in respect of 1st December, €105 for 16th December and €60 for 22nd December 2018. She is also owed €105 for a cheque that was returned by the bank, details provided. The total amount claimed is €375.
She understands from Social Media that the business has closed down.
Summary of Respondent’s Case:
The Respondent did not attend and was not represented. |
Findings and Conclusions:
I note correspondence on file advising both parties of the venue, date and time of the hearing. I note that the Respondent did not attend and was not represented. Based on uncontested evidence I find that the Complainant is owed wages as claimed above. I find that the Respondent has breached Sec 5 of this Act. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I have decided that the Respondent has breached Sec 5 of this Act.
I have decided that this complaint is well founded.
I order the Respondent to pay the Complainant €375 within six weeks of the date below.
