Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 andfollowing the referral of the complaint to me by the Director General, a Hearing was scheduled for 22nd August 2018 at 9am in the Workplace Relations Commission. The Respondent attended this scheduled Hearing on 22nd August 2018. The WRC had received an email from the Complainant at 4.30 on 21st August 2018 stating that she was unable to travel from Brussels to the scheduled Hearing due to difficulty in getting to the Airport on time.
The complaint was rescheduled for a further Hearing on 9th October 2018, and the Complainant was informed of this scheduled Hearing. The Complainant did not attend this rescheduled Hearing. The Respondent did attend this rescheduled Hearing.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant lodged a complaint with the Workplace Relations Commission on 26th March 2018 alleging the Respondent had breached the Payment of Wages Act, 1991. A Hearing was scheduled for 22nd August 2018. On 21st August 2018 the Complainant sent an email to the WRC asserting she had been delayed in getting her flight from Brussels to Dublin for the scheduled Hearing. A second Hearing was scheduled for 9th October 2018 and the Complainant and Respondent were informed of the scheduled Hearing. The Complainant failed to attend this second scheduled Hearing on 9th October 2018. In accordance with Section 421(5) of the Workplace Relations Act, 2015 I declare this complaint is not well founded. |
