Procedure:

In accordance with Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.

The claimant was employed by the respondent from the 23rd April 2018 until the 14th June 2018. He stated that he was paid €430 gross (€328 nett) working a 38-hour week.

The claimant submitted that he had been on to the Revenue Commissioners about the emergency tax that was being deducted from his wages. He stated that the Revenue had informed him everything was in order on their side and that it was a matter for the respondent to sort it out.

He added that he had meetings with the General Manager, Head Chef and the respondent’s accountant to no avail. He submitted that despite his best efforts to resolve the issues he was still on emergency tax.

He stated that his contract had been changed without his knowledge he felt that the stress that he was put under that it was not conductive for him to attend work on that day.

The claimant stated that he was let go without telling or notifying him of the reasons.

The claimant said that he never received any documentation that inform him of his dismissal.

Findings

The respondent did not attend.

The complaint was received on the 3rd July 2018.

I find that based on the evidence that was provided at the hearing fair procedures were not applied.

Decision:

Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.

Based on the uncontested evidence I award the claimant €500 in compensation.
