Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969] following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
This is a complaint concerning the alleged attempts of the respondent to undermine her. The complainant was notified of the hearing date. She did not attend. |
Summary of Complainant’s Case:
The complainant was duly notified of the details of the hearing. Neither the complainant nor her solicitor attended. The complainant’s solicitor emailed a request at the time of the commencement of the hearing for an adjournment as the complainant’s child minding arrangements had fallen through and she is a single parent. I received this some minutes after the scheduled commencement of the hearing. |
Summary of Respondent’s Case:
The respondent and his solicitor attended. Contrary to assurances, they had received nothing from the complainant’s solicitor. They objected to the request for an adjournment put to them after the scheduled time for the commencement of the hearing. |
Findings and Conclusions:
The complainant failed to notify the WRC in advance of the hearing of inability to attend. The complainant’s solicitor chose not to attend the hearing to request an adjournment. |
Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.]
In all of the circumstances described above, I do find there is merit in this complaint. |
