Procedure:

In accordance with Section 41 of the Workplace Relations Act, and following the referral of the complaint to me by the Director General, a Hearing was scheduled for 8th January 2019.

BACKGROUND.

The Complainant was employed by the Respondent from 22nd April 2018 until the employment terminated on 7th July 2018. The Complainant referred complaints to the Workplace Relations Commission on 29th September 2018 alleging the Respondent had breached the Payment of Wages Act, 1991 in respect of wages not paid – accrued annual leave not paid and his minimum notice entitlement not paid.

A Hearing was scheduled for 8th January 2019. The Complainant did not attend the scheduled Hearing. The Respondent and the Interpreter, requested by the Complainant, did attend on 8th January 2019. I am satisfied the Complainant was informed of the Hearing scheduled for 8th January 2019.

DECISION.

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.

A Hearing was scheduled for 8th January 2019. The Complainant did not attend this scheduled Hearing. I am satisfied the Complainant was informed of the date, time and place of the Hearing scheduled for 8th January 2019.

In accordance with Section 41(5) of the Workplace Relations Act, 2015 I declare the complaints are not well founded.
