Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015, this complaint was assigned to me by the Director General. A hearing was arranged for February 15th 2019, for the parties to have an opportunity to be heard and to present evidence relevant to the complaints.
The complainant and his solicitor did not attend, although they were properly on notice of the hearing. A company director attended for the respondent, accompanied by his HR Consultant.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well founded and I decide accordingly. |
