Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969 and following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The worker is employed by the employer as a sales administrator since 20th October 2015. She referred a grievance to the employer concerning bullying and harassment. The employer carried out an investigation, but the complaint was not upheld. The worker then referred the dispute to the WRC. |
Recommendation:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
The parties agreed that I recommend the following to resolve the dispute: An independent appeal of the investigation report already issued will be offered to the worker and this appeal will be completed within a reasonable timeframe. The employer has agreed that a fresh investigation of the new matters raised by the worker at the WRC hearing will be initiated. The employer will recirculate the company’s Bullying and Harassment Policy to all staff and will draw particular attention to the definitions contained at paragraph 3 and 4 of the Policy. |
