1. Trade Union Recognition.
BACKGROUND:
2. This case relates to a dispute over Trade Union recognition. The Union referred the matter to the Labour Court on 11 October 2018 in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 5 March 2019. The Employer declined to attend the hearing.
RECOMMENDATION:
This matter comes before the Court as a referral by the Trade Union under Section 20(1) of the Industrial Relations Act, 1969. The employer did not attend the hearing and the Court has not had the benefit of a submission from the employer.
The Trade union has submitted that it represents 25 employees of the company and it seeks to represent its members collectively on issues related to their employment. The Trade Union seeks recognition as the representative of its members for collective bargaining purposes and seeks to negotiate a collective agreement with the employer dealing with all work related issues and dispute resolution procedures.
In the absence of any submission from the employer in the matter the Court recommends that the claims of the Trade Union should be conceded.
The Court so recommends.
