Workplace Relations Commission Adjudication Officer: Niamh O'Carroll Kelly B.L.
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
No Appearance for or on behalf of the complainant. |
Summary of Respondent’s Case:
The complainant has not appeared to prosecute her claim. The claim is without merit and should be dismissed for want of prosecution. |
Findings and Conclusions:
There was no appearance for or on behalf of the complainant. Having made enquires, I am satisfied that the complainant was on notice of the date, time and venue for the hearing. The respondent made an application to have the decision anonymised. The respondents are a law firm in this jurisdiction whose reputation could be adversely affected by the unfounded allegations in the within claim. On that basis I find that the decision should be anonymised. On the basis that the complainant has not appeared to prosecute her claim, I find that he complaint is not well founded and according fails. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complaint fails. |
