Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The complainant has been employed with the respondent since November 2002 initially as a general operative. The parties have made previous attempts to resolve this matter. |
Summary of Complainant’s Case:
In 2008 the Print-room Supervisor was reassigned to a different role and the complainant took over a number of the duties of the position. Since that time the complainant’s duties have expanded to cover supervision of all aspects of Print-room operations. The complainant is seeking to be appointed as a Grade D with appropriate retrospection. |
Summary of Respondent’s Case:
The respondent submits that a role sizing request was submitted in 2019 and concluded that the complainant’s role in in line with the market rate of pay for a position of that breadth and responsibilities. |
Findings and Conclusions:
I am satisfied that given the unique nature of the complainant’s position within the respondent organisation that a further job evaluation would be useful in determining this matter |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
Having regard to the oral and written submissions in relation to this matter, I recommend that this specific dispute be referred to an agreed independent job evaluation expert to conduct an analysis of the different roles and responsibilities afresh and to make a recommendation as to the appropriate grade for the Complainants job. The independent expert and the timeframe for this process should be agreed between the parties and the outcome of the review should be limited to the complainant’s position and not represent a precedent for other roles in the area. |
