Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 13 of the Industrial Relations Acts 1969 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant commenced employment with the Respondent in February 2015 and remains employed. The Respondent organisation was taken over in October 2018 at which time employment transferred to the present company. This complaint was received by the Workplace Relations Commission on 27th June 2019. |
Summary of Complainant’s Case:
The Complainant contends that he feels bullied and harassed by his team manager and when he raised this with the HR team no action has been taken. It was admitted that he was attending a disciplinary hearing when he raised the point about being bullied and harassed. The Complainant feels he is being victimised at work and no one can help him. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing of this complaint. |
Findings and Conclusions:
I have advised the Complainant that if he feels he is being bullied and harassed at work he should make a formal complaint and this would be investigated by the appropriate personnel within the workplace. I would recommend that the Respondent conduct such an investigation and should there be any doubt in relation to how to go about this they should consider the procedure outlined in the Code of Practice issued by the Workplace Relations Commission and may be found on the WRC website. Alternatively, the Health and Safety Authority have issued a code of practice that may also be utilised. The Respondent organisation have to produce a policy on this subject and employees have to be made aware how to use it. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
