1. Claim for progression on a salary scale
BACKGROUND:
2. This dispute concerns a pay claim. The Worker referred this case to the Labour Court on 7 June 2019 in accordance with Section 20 (1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court’s Recommendation. A Labour Court hearing took place on 24 October 2019.
RECOMMENDATION:
This case was referred under section 20 (1) of the Industrial Relations Act 1969. The issue in dispute has been the subject of an Adjudication Officer’s Recommendation which has not been appealed to the Labour Court .
Section 13(10) of the Industrial Relations Act 1969 states; “The Court shall not investigate (except by way of appeal to it under subsection (9) of this section) a trade dispute in relation to which a rights commissioner has made a recommendation”
The Court does not have jurisdiction to hear this claim.
