Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 7 of the Terms of Employment (Information) Act, 1994,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The case concerned the alleged shortfall in issuing a written statement of terms of employment during a 1.5-year span of employment. |
Summary of Complainant’s Case:
The complainant submitted a written complaint wherein he stated that he had never received any contract or terms of employment. He submitted that he had to remind his employer on the focus of his work and his terms changed every week depending on the preceding weeks work performance. The Complainant did not attend the hearing and did not submit any reason for his non appearance. |
Summary of Respondent’s Case:
The Respondent did not engage with the claim, either by responding to the claim or by attendance at hearing. The Company did not submit any reason for non-appearance. |
Findings and Conclusions:
I prepared the case to hear both party’s submissions. Neither party contacted any reason for their nonattendance at hearing. I waited half an hour to allow for any mishaps. I am satisfied that both parties were notified of hearing on June 11,2018. I have completed my role as Adjudicator in the case and find that the claim has not succeeded for want of prosecution. |
Decision:Section 41 of the Workplace Relations Act 2015 requires that I decide in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. Section 7 of the Terms of Employment (Information) Act, 1994 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
