Procedure:
In accordance with Section 41 of the Workplace Relations Act 2015, these complaints were assigned to me by the Director General. A hearing was arranged for September 25th 2019 for the parties to have an opportunity to be heard and to present evidence relevant to the complaints.
Just before 9.00am on the morning of September 25th, I received an e-mail from the case officer informing me that the complainant phoned that morning at 7.50am to say he would not attend the hearing because he is now living in England. The complainant also sent an e-mail to the Post-registration Unit of the WRC confirming this.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well founded and I decide accordingly. |
