1. Individual and collective union representation
BACKGROUND:

The case before the Court concerns the Union's claim to represent their Members individually on grievance and disciplinary matters in line with SI 146 of 2000 and collectively on all terms and conditions of employment. The Union referred the matter to the Labour Court in accordance with Section 20(1) of the Industrial Relations Act, 1969. A Labour Court hearing took place on 26 September 2019. The Employer was not in attendance. The following is the Recommendation of the Court:-
RECOMMENDATION:
The Court recommends that the Company should recognise the Union as the chosen representative of those employees who join the Union for all industrial relations purposes including individual representation in line with SI 146 of 2000.
The Court further recommends that the parties should enter into negotiations with a view to concluding a collective agreement dealing with, amongst other things, the procedural arrangements within which the normal industrial relations business will be conducted between them.
