Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 11 of the Minimum Notice & Terms of Employment Act 1973, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The Complainant was employed as a Cashier with the Respondent from 5th October 2015 until 23rd March 2019 when the shop closed without notice. The Complainant stated that she received no notice or payment in lieu and no holiday pay or redundancy payment. The Complainant was on a 40 hour week contract at a rate of €12 per hour. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. |
Decision:
The Complainant is entitled to be paid minimum notice of two weeks. I find her complaint to be well founded and I require the Respondent to pay to the Complainant the sum of €960 within six weeks of the date of this decision.
