Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is seeking adjudication by the Workplace Relations Commission under Section 25 of the Protection of Employees (Temporary Agency Work) Act, 2012 and has submitted that as an agency worker he did not receive the same basic working and employment conditions to which a comparable worker would be entitled (CA-00027360). |
Summary of Complainant’s Case:
There was no appearance on behalf of the Complainant. The Complainant was informed of the hearing of this matter by letter from the Workplace Relations Commission dated the 2nd July 2019. |
Summary of Respondent’s Case:
The Respondent Company attended the hearing. |
Findings and Conclusions:
It was confirmed that the Complainant was on notice of the hearing of this matter as per the letter of the 2nd July 2019 from the Workplace Relations Commission which was sent to the Complainants correct address as per the Complaint Form. Further, the Complainant was forwarded a copy of a communication from the Respondent dated the 18th July 2019 from the Workplace Relations Commission on the 23rd July 2019. Accordingly, the Complaint (CA-00027360) is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the Complaint (CA-00027360) is not well founded. |
