Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant is seeking adjudication by the Workplace Relations Commission under Section 6 of the Payment of Wages Act, 1991 and has submitted that he was not paid for his last week of employment, public holidays or in lieu of unclaimed annual leave.

Summary of Complainant’s Case:

There was no appearance by or on behalf of the Complainant.

The Complainant was informed of the hearing of this matter by letter from the Workplace Relations Commission dated the 23rd July 2019.

Summary of Respondent’s Case:

The Respondent attended the hearing.

The Respondent Company stated that the Complainant had been paid €295.80 by cheque and this had cleared the appropriate bank on the 10th June 2019.

Findings and Conclusions:

It was confirmed that the Complainant was on notice of this hearing as per the letter of the 23rd July 2019 which was sent to the Complainants home address as per the Complaint Form dated the 4th June 2019.

Accordingly, the Complaint (CA-00028826) is not well founded.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

I find that the Complaint (CA-00028826) is not well founded.
