Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent from 14/03/2011to 15/02/2019 at which time the Respondent ceased trading and the Complainant was made redundant. The Complainant worked 26 hours per week for which she was paid €287.54 per week. This complaint was received by the Workplace Relations Commission on 8th July 2019. |
Summary of Complainant’s Case:
When she was made redundant the Complainant was not paid her outstanding accrued holiday pay of €319.44. |
Summary of Respondent’s Case:
The Respondent did not dispute the facts as presented by the Complainant. |
Findings and Conclusions:
The Complainant has an entitlement to be paid any accrued holiday entitlement when the Respondent ceased trading. I now order the Respondent to pay the gross amount of €319.44 to the Complainant within 42 days from the date of this decision. |

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
