Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant worked for the respondent from 12/05/2014 until 15/02/2019. When employment ended the Complainant did not receive her statutory notice or her outstanding holiday entitlement. This complaint was received by the Workplace Relations Commission on 8th July 2019. |
Summary of Complainant’s Case:
The Complainant contends that she did not receive her statutory notice period or payment in lieu of such notice and that she has an outstanding holiday entitlement for which she is entitled to payment for. |
Summary of Respondent’s Case:
The Respondent did not dispute the claims presented by the Complainant. |
Findings and Conclusions:
The Complaint presented by the Complainant is well founded. The Complainant is entitled to one weeks’ notice i.e. €148.37 The Complainant is entitled to a payment of €229.71 representing her outstanding holiday entitlement. These gross sums should be paid to the Complainant within 42 days from the date of this decision. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
