Procedure:
On the 18th September 2018, the complainant referred a complaint pursuant to the Equal Status Act. The complaint was scheduled for adjudication on the 19th December 2018.
At the time the adjudication was scheduled to commence, it was apparent that there was no appearance by or on behalf of the complainant. The respondent was in attendance to meet the claim. I verified that the complainant had been notified of the time, date and venue of the adjudication. Having taken this step, I proceeded with the hearing in the absence of the complainant.
In accordance with section 25 of the Equal Status Act, 2000following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
This is a complaint pursuant to the housing assistance ground. The complainant did not attend to give evidence of a contravention of the Equal Status Act. |
Summary of Respondent’s Case:
The respondent attended the adjudication to meet the claim. |
Findings and Conclusions:
The complainant has not adduced evidence to show that there was a contravention of the Equal Status Act or established facts of such significance that raise an inference of discrimination. I, therefore, find that the complaint does not succeed. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
CA-00021904-001 I decide that the complaint pursuant to the Equal Status Act fails as the complainant has not established a prima facie case of discrimination under the housing assistance ground. |
