Procedure:
This complaint was submitted to the WRC on September 23rd 2019 and, in accordance with Section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for January 8th 2020 for the parties to present evidence in respect of the complaint; however, the complainant did not attend.
I understand from the case officer that at 3.00pm on January 7th, a person representing the complainant sent an email to the WRC to state that he would not attend as his mother was in hospital. On behalf of the complainant, his representative requested an adjournment. In the absence of any documentary evidence to support the reason for his non-attendance, an adjournment was not granted.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well-founded and I decide accordingly. |
