Procedure:
These complaints were submitted to the WRC on October 17th 2019 and, in accordance with Section 41 of the Workplace Relations Act, they were assigned to me by the Director General. A hearing was arranged for February 19th 2020 for the parties to present evidence in respect of the complaints; however, the complainant did not attend. I am satisfied that he was informed in writing of the date, time and place at which the hearing to investigate his complaints would be held. The proprietor of the restaurant attended and he was accompanied by his legal advisor.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well-founded and I decide accordingly. |
