Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
On 30 October 2019, the Complainant submitted a complaint under Payment of Wages Legislation. On 13 January 2020 a hearing notice issued to both parties to the complaint. On 5 February 2020 a hearing was held and neither party was in attendance.

Summary of Complainant’s Case:
The Complainant submitted on his complaint form that he had worked as a Tradesman with the respondent from 7 August 2019 until 14 August 2019. He stated that he had not been paid for his work. The Complainant did not attend the hearing or furnish any reason for this. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent at hearing. The Respondent did not lodge a response to the claim. |
Findings and Conclusions:
I have considered the complaint form submitted in this case. I proceeded to hold a hearing as notified by letter to both parties. There was no appearance by either party at hearing. I am satisfied that both parties were on notice of the hearing. I have not received any reason for either party’s non-appearance. I allowed 30 mins before I commenced the hearing time to allow for any eventualities on logistics. The Complainant has not attended to outline or particularise his complaint. I have found that his complaint is not well founded. |
Decision: Section 41 of the Workplace Relations Act 2015 requires that I decide in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. The claim is not well founded.
