Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00032445-001 | 23/11/2019 |
Date of Adjudication Hearing: 20/02/2020
Workplace Relations Commission Adjudication Officer: Janet Hughes
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 6 of the Payment of Wages Act,1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The complaint was concerned with non-payment of wages for a day worked with the Respondent on November 11th, 2019. A complaint form was received by the WRC on November 20th, 2019. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. Notification of the date of hearing was issued by the WRC on January 8th, 2020. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. Notification of the date of hearing was issued by the WRC on January 8th, 2020. |
Findings and Conclusions:
As neither party attended the hearing, no conclusions can be drawn from the available information. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. Section 6 of the Payment of Wages Act,1991-2017 requires that I make a decision in accordance with the provisions of that section
I am satisfied that both parties were informed of the date of the hearing. As no evidence was presented to support the complaint, the complaint of a deduction under Section 5 of the Payment of Wages Acts is deemed to be not well founded. |
