Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 6 of the Payment of Wages Act,1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Background:

The complaint was concerned with non-payment of wages for a day worked with the Respondent on November 11th, 2019. A complaint form was received by the WRC on November 20th, 2019.

Summary of Complainant’s Case:

The complainant did not attend the hearing. Notification of the date of hearing was issued by the WRC on January 8th, 2020.

The Respondent did not attend the hearing. Notification of the date of hearing was issued by the WRC on January 8th, 2020.

Findings and Conclusions:

As neither party attended the hearing, no conclusions can be drawn from the available information.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act. Section 6 of the Payment of Wages Act,1991-2017 requires that I make a decision in accordance with the provisions of that section

I am satisfied that both parties were informed of the date of the hearing.

As no evidence was presented to support the complaint, the complaint of a deduction under Section 5 of the Payment of Wages Acts is deemed to be not well founded.
