Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant commenced employment with the Respondent on 8th July 2019, this employment ended on 24th August 2019. The Complainant’s hours of work varied during this period and in total she worked one hundred and seventy-four hours. This complaint was received by the Workplace Relations Commission on 22nd February 2020 and was the subject of a remote hearing on 5th August 2020. |
Summary of Complainant’s Case:
The Complainant worked for the Respondent as a receptionist from 8th July 2019 to 24th August 2019.
The Complainant was not paid for the month of July, it was communicated to her that they, the Respondent, had misplaced the documentations relating to her employment.
When Head Office found the relevant documentation, the Complainant was informed that she would get paid during the next payroll cycle, but this never happened.
The Complainant has made several attempts to contact the Respondent, her efforts have not been successful. |
Summary of Respondent’s Case:
By email dated 22nd June 2020 the Administrators acting for the Respondent informed the WRC that the Respondent company would not be represented at the hearing, this was verified by telephone on 5th August 2020. |
Findings and Conclusions:
Based on the uncontested evidence adduced at the hearing I accept the Complainant’s version of events and accept that the Complainant is owed the amounts stated i.e. unpaid wages of €1,740 and unpaid holiday entitlement of €129.60. This is a clear breach of the Payment of Wages Act, 1991. I now order the Respondent to pay the complainant a gross sum of €1,869.60. This payment should be made to the Complainant within 42 days from the date of this decision. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I now order the Respondent to pay the complainant a gross sum of €1,869.60. This payment should be made to the Complainant within 42 days from the date of this decision. |
