Complaint seeking adjudication by the Workplace Relations Commission under Section 21 Equal Status Act, 2000 | CA-00032652-001 | 03/12/2019 |
Date of Adjudication Hearing:
Workplace Relations Commission Adjudication Officer: Davnet O'Driscoll
Procedure:
In accordance with Section 25 of the Equal Status Act, 2000following the referral of the complaint to me by the Director General, I inquired into the complaint, and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is a tenant of the Landlord since 2010. |
Summary of Complainant’s Case:
The Complainant sought Housing Assistance Payment from Dublin City Council in July 2018 and requested the Landlord to complete the forms. The Landlord refused to do this. As a result, the Complainant was unable to pay his rent and evicted in April 2019 and made homeless. The claim is made outside of time-limits as the Complainant has been made homeless and stressed. The complaint was received by the Workplace Relations Commission on 3rd December 2019. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
There was no appearance by or on behalf of the Complainant or the Respondent at the hearing. I am satisfied that the said Complainant and his representative were informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. In the circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded.
|
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complaint is not well founded. |
