SUBJECT:

1.Bullying and Harassment.

BACKGROUND:

2.The case concerns a claim by the Worker that she was bullied and harassed due to the denial by the Employer that a transfer of the business took place resulting in her leaving her employment.

On 19 October 2020, the Worker, referred this dispute to the Labour Court in accordance with Section 20(1) of the Industrial Relations Act, 1969 and agreed to be bound by the Court's Recommendation.

A Labour Court hearing took place remotely on 25 November 2020.

RECOMMENDATION:

On the basis of uncontested examples given, the Court is satisfied that the Worker was subjected to a level of bullying and harassment and recommends that the Employer pays her €1000 in compensation in full and final settlement of this claim.
