Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The claim was for outstanding wages.

Summary of Complainant’s Case:
The Complainant’s case was that he was last paid wages on the 6th of December 2018. He was due wages of €3,600.00.

Summary of Respondent’s Case:
The Respondent did not attend that hearing. The Respondent did attend an earlier hearing for a colleague of the Complainant who had a similar claim.
At that hearing the owner of the Respondent confirmed that the monies were due to the Complainant and his colleague.
He explained how the company had ceased trading and was not able to discharge the wages due. A liquidator had not been appointed to wind up the Respondent. |
Findings and Conclusions:
The facts were not in dispute. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The case is well founded. I award the Complainant a gross payment of €3,600.00. |
