Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaints to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant submitted claims under s. 7 of the Terms of Employment (Information) Act 1994 and s. 13 of the Industrial Relations Act 1969. |
Summary of Complainant’s Case:
Having given the Complainant additional time to attend, there was no appearance by him or on his behalf. Having carefully reviewed the file I am satisfied that the Complainant received the notification of the hearing date as he was in direct communication with the Workplace Relations Commission. |
Summary of Respondent’s Case:
The Respondent’s representatives appeared at the hearing ready to meet the Plaintiff’s claims. |
Findings and Conclusions:
Having given the Complainant additional time to attend, there was no appearance by him or on his behalf. Consequently, and in the absence of evidence of his claims, I conclude that the claims must fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act
