Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 [and/or Section 39 of the Redundancy Payments Acts 1967 - 2014 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, and/or Section 9 of the Protection of Employees (Employers’ Insolvency) Acts, 1984 - 2012, and/or Part VII of the Pensions Acts 1990 - 2015 and/or Section 79 of the Employment Equality Acts, 1998 - 2015, and/or Section 25 of the Equal Status Act, 2000, and/or Section 13 of the Industrial Relations Acts 1969] following the referral of the complaint / dispute to me by the Director General, I inquired into the complaint / dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint / dispute.
Background:
The complaint relates to the provision of rented accommodation at a premises in Galway in the period October 2017 to January 2019. The complainant had a tenancy with the respondent during some or all of that period. The complaint relates to HAP during and at the end of the period. Date of receipt of complaint: 23/04/2019 |
Summary of Complainant’s Case:
The complainant was notified of the date and time of the hearing at the address provided to the Workplace Relations Commission on her form which was received on 23/04/2019. There is no other address on record. The complainant did not attend on the date notified to her on September 23rd, 2019 at the address provided. No evidence was provided to support the complaint. |

The named respondent did not attend for the hearing. |
Findings and Conclusions:
As no evidence was presented at the hearing to support the complaint, the complaint cannot be regarded as valid. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint / dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act
Under Section 25 of the Equal Status Acts,200-2015 I decide that, in the absence of evidence from the complainant on the date provided for an investigation of the complaint under Section 21 of said Act, that the complaint brought by Joanna Carty is not upheld. Accordingly, I decide that no cause for redress arises from the terms of Section 27. |
