Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant alleged discrimination against him by the respondent in respect of an electricity top-up and verbal abuse. |
Summary of Complainant’s Case:
The complainant did not attend the adjudication hearing and was not represented. |
Summary of Respondent’s Case:
The respondent’s rep. attended the hearing for the purpose of denying the complainant’s allegation. Given the complainant’s ‘no show’, no such response was warranted. |
Findings and Conclusions:
The complaint was received by the Director General of the Workplace Relations Commission on April 28th, 2019, whereupon the complainant alleged that the respondent contravened the provisions of the Equal Status Act 2000. The complaint was assigned the complaint application number CA-00027999-001. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for Dec. 13th 2019. There was no appearance by or on behalf of the complainant at the hearing. Having consulted both the case file and with the Case Officer, it was evident that the letters of invitation to hearing had been issued and that there had been no communication from the complainant in respect of his non-attendance. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
In the aforementioned circumstances, I conclude that the relevant complaint is not well founded. |
