Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant stated that she was dismissed from her employment and did not receive her statutory minimum notice entitlements. |
Summary of Complainant’s Case:
The complainant claimed that she was dismissed from her employment on 15th July 2019 and did not subsequently receive her minimum notice payment. |
Summary of Respondent’s Case:
The respondent produced the complainant’s final payslip dated 30th July 2019. It was claimed that this showed that she received her minimum notice payment of €386.75. |
Findings and Conclusions:
I am satisfied that the final payslip dated 30th July included a payment of €386.75, which represented the complainant’s statutory notice entitlements. The complainant acknowledged receiving this payment but was unaware that it constituted her notice entitlements. Accordingly, the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
