Procedure:
In accordance with Section 41 of the Workplace Relations Act, Section 45A of the Industrial Relations Act, 1946;Section 7 of the Terms of Employment (Information) Act, 1994 and Regulation 18 of the European Communities (Road Transport)(Organisation of Working Time of Persons Performing Mobile Road Transport Activities) Regulations 2012 - S.I. No. 36/2012 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The issues in contention concern the rates of pay given to an employee by a Construction Company. The Complainant was a new arrival to Ireland and this had been his first job. |

Section 41 of the Workplace Relations Act 2015; Section 45A of the Industrial Relations Act, 1946;Section 7 of the Terms of Employment (Information) Act, 1994 and Regulation 18 of the European Communities (Road Transport)(Organisation of Working Time of Persons Performing Mobile Road Transport Activities) Regulations 2012 - S.I. No. 36/2012 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions of the cited Acts.
An award of € 2,160.60 under Section 45 A of the Industrial Relations Act, 1946 is made in favour of the Complainant.
A Compensation award of €100 is made under Section 7 of the Terms of Employment (Information) Act, 1994 in favour of the Complainant.
Taxation of the Awards to be considered in conjunction with the Irish Revenue commissioners.
