Date of Adjudication Hearing: 06/12/2019
Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The complainant was employed by the respondent from 17th March 2008 to 16 December 2013. She claimed that she did not receive written terms and conditions of employment and that she was bullied and isolated in the workplace. |
Summary of Complainant’s Case:
Despite having been informed in writing on 7th November 2019 of the date and time of the hearing, the complainant did not attend to give evidence on the day. |
Summary of Respondent’s Case:
Despite having been informed in writing on 7th November 2019 of the date and time of the hearing, the respondent did not attend to give evidence on the day. |
Findings and Conclusions:
Having reviewed the correspondence issued to the complainant, I am satisfied that she was on notice of the hearing but did not attend to give evidence. Accordingly I cannot make a recommendation that is favourable to her in relation to the complaints under the Industrial Relations Act and I find that her complaint under the Employment (Information) Act, 1994 is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
