Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

The complaint refers to allegations that the complainant did not receive any redundancy payment and that the respondent did not provide proof on its inability to pay redundancy. |

The complaint submitted that he did not receive any redundancy payment and that the respondent did not provide proof on its inability to pay redundancy. |

There were no submissions made by the respondent. |
Findings and Conclusions:
Neither the complainant nor the respondent attended the hearing of this matter. I am satisfied that both parties were on notice of the details relating to the hearing. Accordingly, I find that as no evidence was presented at the hearing to be tested, I am not satisfied that this complaint can be upheld. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
My decision is that as no evidence was tested at the hearing, the complaint cannot be upheld and it must therefore fail. |
