Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant did not attend the hearing. In her complaint form, the complainant detailed that she had been unfairly dismissed. |
Summary of Complainant’s Case:
The complainant did not attend. I confirmed that a letter had issued notifying the complainant’s representative of the date, time and location of the hearing. In the complainant’s complaint form, the complainant detailed that she had worked for the respondent for over 10 years and that her employment was terminated unfairly as it was alleged that she had brought the practice into disrepute. |

The respondent refuted the claim that the complainant was unfairly dismissed. |
Findings and Conclusions:
A complaint was received by the Director General of the Workplace Relations commission by the complainant on 10th May 2019, alleging that the employer contravened the provisions of Section 8 of the Unfair Dismissals Act. The said complaint was referred to me for investigation. A hearing for that purpose was held on 7th February 2020. There was no appearance by or on behalf of the complainant at the hearing. The respondent attended the hearing and refuted the claims. I am satisfied that the said complainant was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I must dismiss the complaint. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
In the circumstances referred to above, I must conclude that the within complaint is not well-founded and I dismiss the complaint. |
