Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
No Appearance by the complainant. However, the complainant’s Union Representative was present in relation to the two co-complainants. It was agreed that the decision in ADJ 22009 and ADJ 22011 would apply to this complainant despite him not being present. |
Summary of Respondent’s Case:
No evidence was adduced due to the complainant’s failure to attend for the hearing. |
Findings and Conclusions:
As no evidence was adduced on behalf of this complainant, I find that this matter, due to the lack of evidence is not well founded and accordingly fails. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint fails. However, It was agreed that the decision in ADJ 22009 and ADJ 22011 would apply to this complainant, despite him not being present. |
