Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The complainant (originally) alleged unfair selection for redundancy and a failure to pay ‘minimum notice’ terms under the relevant enactment. The latter claim was the subject of the re-arranged hearing. |

Findings and Conclusions:
The complaints were received by the Director General of the Workplace Relations Commission on July 22nd 2019, whereupon the complainant alleged that his former employer contravened provisions in the specified enactment. The complaints were assigned the complaint application numbers CA-00023266-003; CA-00023266-004 and CA-00023266-005 The said complaints were referred to me for investigation. A hearing for that purpose was arranged for December 12th, 2019. There was no appearance by or on behalf of the complainant or the respondent at the hearing. Having consulted both the case file and with the Case Officer, it was evident that the letters of invitation to hearing had been issued and that there had been no communication from either the complainant or the respondent in respect of same. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the aforementioned circumstances, I conclude that the relevant complaints are not well founded. |
