Procedure:
In accordance with Section 41 of the Workplace Relations Act,following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s)and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background
The claimant stated that he was employed with the respondent from the 8th April to the 23rd of July 2019. He was paid €500 gross working a 37 hours week. The claimant stated that he was not provided with a contract of employment.
The respondent stated that he provided the claimant with a contract on the 8th April 2019 by email however he never got it back.
Findings
I find that the respondent submitted a copy of the email at the hearing where it was sent on the 8th April at 15.36 pm to the claimant.
I find that the claimant was employment for a period of 15 weeks.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the
complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find based on the evidence as submitted at the hearing the complaint is not well-founded and falls
