1. Claim for Union Recognition in order to address various working conditions and pay claims.
BACKGROUND:
2. This dispute concerns the Trade Union's claim for recognition for negotiation purposes on behalf of its members for various working conditions and pay claims.. The Union referred this case to the Labour Court on 29 August in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court’s Recommendation. A Labour Court hearing took place on17 January 2020
RECOMMENDATION:
Background to the Dispute
The within dispute, at its core, is a claim for union recognition for collective bargaining purposes. However, the Union presented a very wide-ranging written submission that particularised a number of specific claims in relation to pay, sick pay, staffing levels and Sunday premium, in relation to which it would not be appropriate for the Court to make a recommendation under section 20(1) of the Industrial Relations Act 1969, in the context of a union recognition dispute.
Power Leisure Bookmakers Limited (‘the Company’) declined to attend or be represented at the hearing. The Court was notified of this in advance by letter from the Company’s solicitors.
Recommendation
The Court recommends that the Company should recognise the Union as the chosen representative of those employees who join the Union for all industrial relations purposes.
The Court further recommends that the parties should enter into negotiations with a view to concluding a collective agreement dealing with, amongst other things, the procedural arrangements within the normal industrial relations business will be conducted between them.
The Court so recommends.
