Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The complainant did not attend. The complainant claimed that she was discriminated against. |

The complainant did not attend the hearing.
In her complaint form, the complainant detailed that she was discriminated against by the failure to promote and that she had been discriminated against on on the grounds of family status. |

Findings and Conclusions:
I have taken the decision to anonymise this decision.
A complaint was received by the Director General of the Workplace Relations commission by the complainant on 7th January 2020 alleging that the respondent contravened the provisions of the Employment Equality Acts, 1998 - 2015 . The said complaint was referred to me for investigation.
A hearing for that purpose was held on 11th September 2020. There was no appearance by or on behalf of the complainant at the hearing.
The respondent attended the hearing and refuted the claims.
I am satisfied that the said complainant was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held and that her failure to attend is unexplained.
In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the complainant failed to establish a prima facie case of discrimination, her complaint it is not well founded, and I dismiss the complaint. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complainant has failed to establish a prima facie case of discrimination, and it is not well founded. |
