1.PayIncrease and Negotiate Installation Of Cameras
BACKGROUND:
2.On the 23 June 2020 the Union on behalf of its' members referred the issue to the Labour Court, in accordance with Section 20(1) of the Industrial Relations Act, 1969. A Labour Court hearing took place in a virtual court room on 6 October 2020.
The Union agreed to be bound by the Court’s Recommendation.
RECOMMENDATION:
The matter before the Court concerns a dispute in relation to pay and the use of CCTV following the Company’s refusal to meet with the Union to discuss, negotiate and reach agreement on a collective pay increase for its members in the Company. The claim was referred to the Court under Section 20(1) of the Industrial Relations Act, 1969.
For reasons which were furnished to the Court, the Company did not attend nor was it represented at the hearing.
The Court notes that in 2017 the Union submitted a claim to the Court under Section 20(1) of the 1969 Act, also seeking the right to represent their members in the General Operative grade collectively and individually in engagements and bargaining with the employer. At that time the Court, in Labour Court Recommendation LCR21501, recommended as follows:- - ...that the parties put in place arrangements to provide for collective representation of its membership by the Trade Union in relation to all matters associated with terms and conditions of employment including pay. Those arrangements should complement and function appropriately alongside current arrangements in place as regards a forum for engagement in the company.
Having considered the Union’s submission to the case here before it, the Court reiterates the Recommendation made above and recommends that the Company should meet with the Union to discuss and negotiate on the employment matters referred to the Court herein.
The Court so Recommends.
