1.Appeal the Outcome Of An Internal Grievance
BACKGROUND:
2.On the 3 March the Worker referred the issue to the Labour Court, in accordance with Section 20(1) of the Industrial Relations Act, 1969. A Labour Court hearing took place in a virtual court room on the 25 September 2020.
The Worker agreed to be bound by the Court’s Recommendation.
RECOMMENDATION:
The Employer did not attend the Labour Court hearing. The Worker had three grievances which she notified to her Employer by completing the Grievance Form attached to the Employer’s Grievance Procedure Policy on the 7thDecember 2018. The Worker gave the Court a copy of the form she completed but did not provide a copy of the Employer’s Grievance Procedure. Following the submitting of the complaint a meeting was held on the 10thJanuary 2019 with the Worker and her Union representative. This was followed by a letter from the Deputy CEO Finance and Corporate Services setting out the position in relation to the three grievances and advising that having given consideration to the issues raised that the grievances were not upheld. The Worker did not identify for the Court any failure on the part of the Employer to follow the Grievance Procedure or raise any issue in respect of a breach of the agreed Grievance Procedure therefore, the Worker’s case must fail. The Court so Recommends.
