In accordance withSection 79 of the EmploymentEquality Acts, 1998 - 2015,following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant submitted a compliant under the Employment Equality Act 1998.Previously she was employed by the Respondent as a production worker/team lead for over 7 years until she submitted her resignation in November 2019. A complaint citing the Employment Equality Act 1998, was submitted to the WRC on November 27th,2019. A remote hearing scheduled for August2020 was postponed. A face to face hearing of the complaint was scheduled for September 17th, 2020, notifed to the parties by email on August 13th 2020. |
Summary of Complainant’s Case:
The Complainant failed to attend the scheduled hearing to present her complaint. |
Summary of Respondent’s Case:
As the complaint was not presented by the Complainant at the hearing, the respondent was not required to answer the complaint submitted to the WRC. |
Findings and Conclusions:
I am satisfied that the Complainant was properly notified of the hearing of her complaint. Furthermore, I am satisfied that there is no record in the WRC from the Complainant indicating that she could not attend the hearing as scheduled. As no evidence was presented at the scheduled hearing, I must find that the complaint is not well-founded. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complaint submitted by the Complainant is not well-founded. |
